The new laws are coming into force from 1 July 2024. The most important thing is that the cases which were being heard on the basis of the previous law, the old law will be applicable on them. That is, all the cases registered before July 1, 2024 will not be affected by the new law. Whereas, all the cases registered from July 1, 2024 will be heard according to the new law.
With the change in the previous laws, three new laws (New India Law) have come into force in the country. These include the Indian Civil Defense Code (BNSS), the Indian Justice Code (BNS) and the Indian Evidence Act (BSA). These three laws have been brought afresh. Some changes have been made in them as compared to the old laws. All the old sections have been removed and some new sections have been added. Due to which there will be a change in the legal process.
These three laws have been brought in place of the old law, which is before the independence of India. Let us tell you that till now three criminal laws were in force in India, which include Indian Penal Code (IPC), Code of Criminal Procedure (CrPC) and Indian Evidence Act (IEA). These three laws have been replaced by the Indian Justice Code (BNS), Indian Civil Defense Code (BNSS) and Indian Evidence Act (BSA) respectively.
Many big and important changes have been made under this. There were 484 sections in the Indian Penal Code, while the number of sections in one law, the Indian Civil Defense Code, has reached 531. Along with this, a provision has been made in the Indian Civil Defense Code to release a prisoner who has served the maximum sentence for any crime on private bond.
Under the new law, the concerned department will give permission within 120 days to prosecute any government official. If the department or authority does not give permission, it will also be considered an action. A major change has been made in the new law that any citizen will be able to register a zero FIR in any police station. After this, the case will have to be transferred within 15 days to the original jurisdiction i.e. where the crime took place.
