The Supreme Court's decision on the minority status of Aligarh Muslim University (AMU) was reserved for nine months. Even in the decision given on November 8, after nine months, this matter remains pending. Now a new three-member bench will hear and give its decision on the minority status of AMU. The Constitution Bench of seven judges of the Supreme Court, in its decision given by a majority of four to three on November 8, fixed the basis and standards for an institution to be considered a minority institution, the court did not give any order on the minority status of AMU. It said that the case of AMU will go before the regular bench, which will decide on the basis of the order given in this decision whether AMU is a minority institution or not. The five-judge bench of the Supreme Court had said in its decision in the Aziz Basha case that AMU cannot be considered a minority institution, because it was established through a central law. For so many years, this decision was a hindrance in the way of minority status of AMU. On this basis, the Allahabad High Court had cancelled the law amendment made to grant minority status to AMU.
